THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Our Legal Duties
We are required by law to maintain the privacy of your Protected Health Information (PHI), provide you with notice of our legal duties and privacy practices, and follow the terms of this Notice currently in effect. We are required to notify you following a breach of unsecured PHI.
Uses and Disclosures of PHI Without Authorization
Treatment
We may use and disclose PHI to provide, coordinate, or manage your dental care, including consultations, referrals, laboratory services, prescriptions, and radiology services.
Payment
We may use and disclose PHI to obtain payment for services rendered, including billing insurance companies, verifying coverage, claims management, and collections.
Healthcare Operations
We may use and disclose PHI for practice operations such as quality assessment, staff training, accreditation, licensing, audits, business management, and general administrative activities.
Appointment Reminders and Treatment Communications
We may contact you via phone, text, email, voicemail, or mail to remind you of appointments or provide information about treatment alternatives or health-related benefits and services.
Individuals Involved in Your Care
We may disclose relevant PHI to family members, close friends, or others involved in your care unless you object.
Public Health and Legal Requirements
We may disclose PHI when required by federal or state law, including public health reporting, abuse or neglect reporting, health oversight activities, judicial proceedings, law enforcement purposes, and workers' compensation.
Special Situations
We may disclose PHI for organ donation, research (with safeguards), to avert serious threats to health or safety, and for military or national security purposes as permitted by law.
Uses and Disclosures Requiring Written Authorization
We will not use or disclose PHI for marketing purposes, the sale of PHI, or most uses of psychotherapy notes without your written authorization. You may revoke authorization at any time in writing.
Your Rights Regarding Your PHI
Right to Inspect and Copy
You have the right to inspect and obtain a copy of your PHI in designated record sets, subject to limited exceptions.
Right to Amend
You have the right to request amendments to your PHI if you believe it is inaccurate or incomplete.
Right to an Accounting of Disclosures
You have the right to request an accounting of certain disclosures made in the past six years.
Right to Request Restrictions
You have the right to request restrictions on certain uses and disclosures. We are required to agree to your request not to disclose PHI to your health plan if you pay in full out-of-pocket for the service.
Right to Confidential Communications
You have the right to request communications of PHI by alternative means or at alternative locations.
Right to a Paper Copy
You have the right to receive a paper copy of this Notice upon request.
Changes to This Notice
We reserve the right to change this Notice and make the revised Notice effective for all PHI we maintain. Revised Notices will be available in our office and on our website.
Complaints
If you believe your privacy rights have been violated, you may file a complaint with Smile Solutions or with the Secretary of the U.S. Department of Health and Human Services. You will not be retaliated against for filing a complaint.
